ACCESSING THE SITE
Access to the Site is permitted on a temporary basis, and ENKEV GROUP reserves the right to withdraw or amend the service ENKEV GROUP provides on the Site without notice.
ENKEV GROUP will not be liable if for any reason the Site is unavailable at any time or for any period.
From time to time, ENKEV GROUP may restrict access to some parts of the Site or the entire Site to all or some users of the Site.
You are responsible for making all arrangements necessary for you to have access to the Site. You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these terms, and that they comply with them.
INTELLECTUAL PROPERTY RIGHTS
ENKEV GROUP is the owner or the licensee of all intellectual property rights in the Site and in the material published on it. All such rights are reserved.

ENKEV GROUP’S LIABILITY

To the extent permitted by law, ENKEV GROUP hereby expressly excludes:

This does not affect ENKEV GROUP’s liability for any liability which cannot be excluded or limited under applicable law (including for fraud).
You may use the Site only for lawful purposes. You may not use the Site:
- for viruses, hacking, prohibited uses and other offences
- in any way that breaches any applicable local, national or international law or regulation;
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- for the purpose of harming or attempting to harm minors in any way;
- to send, knowingly receive, upload, download, use or re-use any material which does not comply with ENKEV GROUP’s content standards; or
- to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, ENKEV GROUP will report any such breach to the relevant law enforcement authorities and ENKEV GROUP will co-operate with those authorities by disclosing your identity to them.
In the event of such a breach, your right to use the Site will cease immediately.
SUSPENSION AND TERMINATION
- immediate, temporary or permanent withdrawal of your right to use the Site;
- immediate, temporary or permanent removal of any posting or material uploaded by you to the Site; issue of a warning to you;
- bring legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
- take further legal action against you; or
- disclose such information to law enforcement authorities as ENKEV GROUP reasonably feel is necessary.
LINKING TO THE SITE
You may link to pages of the Site, provided you do so in a way that is fair and legal and does not damage ENKEV GROUP’s reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on ENKEV GROUP's part where none exists.
You must not establish a link from any website that is not owned by you.
The Site must not be framed on any other site, nor may you create a link to any part of the Site other than the home page. ENKEV GROUP reserves the right to withdraw linking permission without notice.

JURISDICTION AND APPLICABLE LAW
The Netherlands courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site although ENKEV GROUP retains the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

WHERE ENKEV GROUP STORES YOUR PERSONAL INFORMATION
Your personal information will be stored and processed on our CRM system, HubSpot, and their secure servers in the European Economic Area but may be accessed in other countries, including USA.
HOW LONG YOUR PERSONAL INFORMATION WILL BE KEPT FOR
Your personal information will only be retained for as long as is reasonably necessary. What this means in practice will vary between different types of information.
We take into account any ongoing need for the information, as well as our legal obligations. Considerations include for example legal and regulatory requirements, tax, health and safety, and potential or actual disputes or investigations. When we no longer need your personal information, it will be deleted.
YOUR RIGHTS IN RELATION TO YOUR PERSONAL INFORMATION
You have a number of rights. These include:
